Times-Standard, PUBLIC HEARING BEFORE THE BOARD OF SUPERVISORS OF THE COUNTY OF HUMBOLDT AND PRE-ADOPTION SUMMARY OF ORDINANCE On Tuesday, September 13, 2016 at 9:00 a.m., or as soon thereafter as the matter can be heard, the Humboldt County Board of Supervisors will hold a public hearing in the Board of Supervisors' Chamber, Humboldt County Courthouse, 825 Fifth Street, Eureka, California, to consider the matter listed below, including the adoption of a proposed Ordinance that performs correcting and clarifying amendments to Ordinance # 2544 - the Humboldt County Commercial Medical Marijuana Land Use Ordinance (CMMLUO). Ordinance #2544 (CMMLUO) represents Phase IV of the Humboldt County Medical Marijuana Land Use Ordinance, and was adopted by the Board of Supervisors on January 26th, 2016. The Ordinance applies throughout the unincorporated areas of the County, including the Coastal Zone, and regulates commercial activities involving the Cultivation, Processing, Manufacturing, and Distribution of Cannabis for Medical Use, consistent with the Medical Cannabis Regulation and Safety Act (MCRSA). The regulations applicable outside the Coastal Zone became effective on February 29th, 2016. Regulations within the Coastal Zone will not take effect until certified by the California Coastal Commission. A Mitigated Negative Declaration (SCH# 2015102005) was previously adopted by the Board of Supervisors, during passage of the CMMLUO (Ord. #2544). Pursuant to section 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines, an activity is not subject to CEQA, when it will not result in a physical change to the environment either directly or indirectly. Furthermore, staff believes the amendments performed by the ordinance do not constitute a "project" as defined under section 15378 of the CEQA Guidelines, in that the adoption of the ordinance will not result in a reasonably foreseeable direct or indirect physical change in the environment. If adopted, the Ordinance would amend section 313-55.4 et seq. to Title III, Division I, Chapter 3, Section B, Part 1 (Coastal Zoning Regulations), and section 314-55.4 et seq. of Title III, Division 1, Chapter 4, Section B, Part I (Inland Zoning Regulations) to the Humboldt County Code. A certified copy of the full text of the proposed ordinance is available in the office of the Clerk of the Board of Supervisors, Room 111, 825 Fifth Street, Eureka, California. Documentation to be filed on this matter for the official record MUST CONTAIN AN ORIGINAL AND NINE (9) COPIES OF EACH DOCUMENT. Documentation includes, but is not limited to: written correspondence, audio and video tapes, maps, photographs, and petitions. If possible, all documentation is to be submitted to the Clerk of the Board of Supervisors, Room 111 of the County Courthouse, 825 Fifth Street in Eureka, (707)476-2384, by noon on Monday, September 5, 2016, for the documents to be placed in the Board's hearing packets.
