North Valley Classifieds, BUTTE COUNTY BOARD OF SUPERVISORS NOTICE OF PUBLIC HEARING EAST OROVILLE AREA FOOTHILLS NOTICE IS HEREBY GIVEN that the Butte County Board of Supervisors will hold a public hearing to consider a County initiated General Plan Amendment and Rezone (GPA/RZ) for properties located in the East Oroville Foothills area, on September 13, 2016, at 9:45 a.m., or shortly thereafter, in the Butte County Board of Supervisors' Room, County Administration Center, 25 County Center Drive, Oroville, California as follows: Project Information Project: GPA/RZ, East Oroville Foothills Location: The area affected by the proposed General Plan Amendment and Rezone is located in the unincorporated area generally east of the City of Oroville, south of the Thermalito Diversion Pool, west of Kelly Ridge, and north of Olive Highway (SR-162), with parcels served primarily by Ward Boulevard, Plumas Drive, Putnam Drive, Belden Court, Canyon Drive, Candy Drive, Sidney Drive, Walnut Avenue, Sharlo Lane, Glen Drive, Glenview Way, Rusty Dusty Road, Post Lane, Almond Avenue, Hillcrest Avenue, Hastie Way, Ridgeview Lane, Riverview Drive, Ridgeview Lane, Wally B Lane, Heritage Road, Palermo Drive, Nash Lane, Pinenut Way, Duke Lane, Sharp Road, Field Drive, Ruggle Road, Valade Court, Hosanna Way, Teancum Court, Ridge Way, Riverview Court, Town View Drive, Quincy Place, and Solana Drive; also including an area generally south of SR-162, north and west of Skyline Blvd. and with parcels served primarily by Quail Ridge Road, Quail Hill Place, Oropond Way, Hillock Way, Janice Way, Hawkridge Lane, Quincy Place, and Apica Avenue. Proposal: A General Plan Amendment and Rezone from LDR (Low Density Residential, allowing up to 3 dwelling units/acre) to VLDR (Very Low Density Residential, 1-acre minimum parcel size) for approximately 290 parcels totaling approximately 1,200 acres for properties in the East Oroville Foothills. This Rezone is a downzoning of allowable residential density from 3 dwelling units/acre to 1 dwelling unit/acre. The Rezone is being proposed to better reflect the character and land uses in this area as supported at a community meeting held by the Development Services Department on June 22, 2015. This GPA/RZ will not change the provisions for residential uses. Single family residential development is a permitted use in both the LDR zone and proposed new VLDR zone. This amendment is proposed to more accurately reflect the rural land uses, development patterns, and lack of municipal sewer service within this area. An Addendum to the previously certified General Plan Environmental Impact Report (EIR) (SCH#2008092062) and Supplemental Environmental Impact Report (GPA and Zoning Ordinance EIR, SCH#2012022059) was prepared to address the environmental effects associated with the proposed amendments to the approved project. As demonstrated in the environmental analysis provided in Section 3.0 (Environmental Analysis) of the Addendum, the proposed amendments do not meet the criteria for preparing a subsequent EIR or negative declaration. An addendum is appropriate because, as explained in Section 3.0, none of the conditions calling for preparation of a subsequent EIR or negative declaration have occurred. APNs: 041-470-075; 041-470-076; and, 041-470-100 Proposal: A Rezone from AG-40 (Agriculture, 40 acre minimum parcel size) to AG-20 (Agriculture, 20-acre minimum parcel size), for three parcels of 48.99, 49.94 and 65.26 acres, fronting on the west side of Pentz Road approximately 2.3 miles south of the Town of Paradise. The front 350 feet of the properties in question are located within the Scenic Highway Overlay Zone, which is not being changed. Because of the proximity of this areas location near other lower density zoning, including an urban subdivision and 10 and 20-acre parcels to the north and east, staff considers this amendment as a necessary correction to match existing land use patterns of the surrounding area. The proposed 20-acre minimum parcel size would also accurately reflect the applicable 20-acre minimum Migratory Deer Herd Overlay zone, whereas the current zone imposes a 40-acre minimum parcel size.
