Times-Standard, PUBLIC NOTICE HUMBOLDT COUNTY PLANNING COMMISSION NOTICE OF PUBLIC HEARING On Thursday, August 6, 2015 at 6:00 p.m., or as soon thereafter as the matter can be heard, the Humboldt County Planning Commission will hold a public hearing in the Board of Supervisors' Chamber, Humboldt County Courthouse, 825 Fifth Street, Eureka, California, to consider the matter listed below. If you have specific questions regarding the proposed project contact the Planning Division at (707) 445-7541. CHRIS NICHOLS MUDDY WATERS COFFEE, McKinleyville area; Application No. 9898; Case Nos. SP 13-024M/MON 15-005, (filed July 1, 2015); Assessor Parcel Number (APN) 511-231-005. The project reviews the first semi-annual monitoring report and modifies two of the original conditions of approval for Muddy Waters Coffee's Special Permit which was approved on February 6, 2014. The conditions of approval included a requirement to submit a monitoring report to the Planning Division after six (6) months of beginning operations, and continue to submit reports, semi-annually, for two years. The monitoring report submitted by the applicant demonstrates compliance with the conditions of approval. No complaints were received by the Planning Division or the North Coast Regional Air Quality Management District (District). The applicant seeks to modify this condition of approval to require future monitoring reports only if there is a complaint received by the Planning Department or the District. The applicant also seeks to modify the condition of approval restricting coffee roasting to the hours between 10 am and 4 pm, Monday through Friday. Due to the need to have scheduling flexibility, the applicant requests to lift the restriction and be able to roast coffee between the hours of 9 am and 5 pm, Monday through Friday. The project is located in Humboldt County, in the McKinleyville area, on the east side of Central Avenue, approximately 1,228 feet north from the intersection of Grange Road and Central Avenue, on the property known as 4159 Central Avenue. FRED VAN ECK FOREST FOUNDATION, Fieldbrook area; Application Number 9587, Case Number GPA-15-001, ZR-15-001 (filed January 9, 2015); Assessor Parcel Numbers (APNs) 512-171-009, 512-181-038, 512-181-039, 516-011-006, 516-011-010, 516-011-014, 516-011-015, 516-011-019, 516-011-020. A General Plan Amendment to amend the General Plan designations of nine parcels owned by the Fred M. Van Eck Forest Foundation from their various plan designations to Timber. The parcels total approximately 142 acres. Also included is a Zone Reclassification to rezone the parcels Timberland Production Zone (TPZ). This will be consistent with the surrounding parcels owned by the Foundation. The parcels are currently encumbered by a Conservation Easement and part of a larger tract that is managed for timber production. The project can be found statutorily exempt from CEQA pursuant to Section 15264 which states: "Local agencies are exempt from the requirement to prepare an EIR or negative declaration on the adoption of timberland preserve zones under Government Code Sections 51100 et seq. (Gov. Code, Sec 51119)." NOTE: The Humboldt County Planning Commission will consider the General Plan Amendment and Zone Reclassification application and forward its recommendation to the Humboldt County Board of Supervisors. The project site is located in the Fieldbrook area, on the east and west sides of Fieldbrook Road, on the properties located in Section 35, Township 7 North, Range 1 East and Section 1, Township 6 North, Range 1 East, Humboldt Base and Meridian. BEAU PRE HEIGHTS Final Map Subdivision Extension, McKinleyville area. Application Number 9843, Case Number FMS-15-003X; Assessor Parcel Number (APN) 510-011-015. A two year extension of a Final Map Subdivision of an approximately 197.3 acre parcel (formerly known as Norton Creek Estates, now termed Beau Pre Heights Subdivision) into 79 residential parcels ranging in size from 1.03 acres - 4.79 acres, and an open space parcel encompassing streamside management areas and wetlands. The Tentative Map will also protect an approximate 36-acre Sitka spruce forest stand deemed a "rare natural community" by the Department of Fish and Game. Pursuant to Section 322.5-1 et seq. H.C.C., an exemption to the solar access standards is requested for all lots based on the fact that all lots in the proposed development are greater than one acre and lot configuration does not constrain solar access. The proposed subdivision would include a small (3.4 acre) community park and series of trails, open to the general public for pedestrian and bicycle use. The project site is accessed from the south via Murray Road and from the north via Norton Road, both of which are two-lane roadways as they approach the site. A portion of the project area is located within the designated Approach Zone (Zone C) for the Arcata-Eureka Airport, however, the proposed densities do not exceed those currently allowed (4 units/acre) for this zone and should not impact the airport in any way. The Arcata-Eureka Airport is located approximately one mile to the northwest of the site. The project includes Street Name Assignments to name the proposed new unnamed access roads that are to serve the proposed subdivision. The project will be served by community water and on-site septic systems. If approved, the extension will extend the life of the tentative map to June 14, 2017. The Humboldt County Planning Commission certified an Environmental Impact Report for the original approval. Any person may appear and present testimony in regard to this matter at the hearing. It is being recommended that the Planning Commission accept a Notice of Exemption adopted by the Humboldt Bay Harbor, Recreation, and Conservation District as lead agency.
