North Valley Classifieds, Ordinance No. 4117 AN ORDINANCE OF THE COUNTY OF BUTTE AMENDING SECTIONS 2-41 AND 2-43 OF CHAPTER 2 OF THE BUTTE COUNTY CODE ENTITLED "ADMINISTRATION" The Board of Supervisors of the County of Butte ordains as follows: Section 1. Section 2-41 of the Butte County Code is hereby amended to read as follows: 2-41 - Director of public works Designated; to head department. The road commissioner shall be the director of public works, and as such shall be the administrative head of the department of public works. Section 2. Section 2-43 of the Butte County Code is hereby amended to read as follows: 2-43 Same Duties. The director of public works shall perform the duties of the road commissioner as defined by law. Section 3. Severability. If any provision of this Ordinance or the application thereof to any person or circumstances is for any reason held to be invalid by a court of competent jurisdiction, such provision shall be deemed severable, and the invalidity thereof shall not affect the remaining provisions or other applications of the Ordinance which can be given effect without the invalid provision or application thereof. Section 4. Effective Date and Publication. This Ordinance shall take effect 30 days after the date of its passage. North Valley Classifieds, Ordinance No. 4118 AN ORDINANCE AMENDING CHAPTER 20, ENTITLED "SUBDIVISIONS," OF THE BUTTE COUNTY CODE The Board of Supervisors of the County of Butte ordains as follows: Section 1. Section 20-133 is amended to read as follows: 20-133 Cul-de-sac streets. (a) The maximum length of a cul-de-sac street, including all cul-de- sac streets accessed from that cul-de-sac street, shall be in conformance with State Public Resources Code section 4290, and California Code of Regulations, Title 14 Natural Resources, Division 1.5 Department of Forestry, Chapter 7 Fire Protection, Subchapter 2 SRA Fire Safe Regulations, as amended and shall apply to unincorporated areas throughout Butte County. The maximum cul-de-sac street length shall depend upon the minimum parcel size specified in the zone applicable to the parcels served by the cul-de-sac street and shall not exceed the following cumulative lengths, regardless of the number of parcels served: (1) Parcels zoned for less than one (1) acreeight hundred (800) feet; (2) Parcels zoned for one (1) acre to 4.99 acresone thousand three hundred twenty (1,320) feet; (3) Parcels zoned for five (5) acres to 19.99 acrestwo thousand six hundred forty (2,640) feet; (4) Parcels zoned for twenty (20) acres or largerfive two hundred eighty (5,280) feet. The cul-de-sac street length shall be measured from the property line of the first parcel that has no access other than the cul-de-sac street and which is nearest the intersection that begins the street to the end of the road surface at its farthest point. Where a cul-de-sac street crosses areas of differing zoned parcel sizes, requiring different length limits, the shortest allowable street length shall apply. (b) Where parcels are zoned five (5) acres or larger, standard turnarounds shall be provided at a maximum of one thousand three hundred twenty (1,320) foot intervals. (c) Each cul-de-sac street shall have a standard turnaround constructed at its terminus. (d) Where the cul-de-sac street length already exceeds the maximum length allowed above, then the parcel shall not be allowed to subdivide without providing circulation with an approved access to reduce the cul-de- sac length to at or below the length allowed under this section. (e) Exceptions to the standards for cul-de-sac streets as defined in this section shall only be granted when all the following circumstances apply shall only be granted as follows: (1) All of the following circumstances apply: i) The exception has concurrence from the Butte County Fire Department/CalFire, and measures have been incorporated into the approval of the tentative map or parcel map to reduce fire hazard in a manner that has the same practical effect as limiting the length of a cul-de-sac street. ii) This exception would apply only when the resulting parcels after subdivision are five (5) gross acres or more in size, or when resulting parcels are similar in size and nature to surrounding parcels. iii) This exception may not be applied within the TPZ, TM or FR zoning districts. or (2) All of the following circumstances apply: i) The exception has concurrence from the Butte County Fire Department/CalFire. ii) If a parcel contains sufficient acreage to allow it to be divided, the parcel may only be divided into two parcels. iii) The zoning would allow the potential for a second dwelling, and the parcel being divided is not already restricted to one dwelling. iv) Each resultant parcel will be restricted to one dwelling until such time as an approved secondary access is provided. No further subdivision of the resultant properties shall be approved until approved secondary access is provided. v) Specific findings shall be made for determination of same practical effect and the restriction limiting residential development to one dwelling. vi) A note shall be placed on the parcel map indicating that each parcel is restricted to one dwelling, and a deed restriction limiting each parcel to one dwelling shall be recorded concurrently with the recordation of the parcel map. The deed restriction shall include a covenant of restriction to run with the land which specifies that a second dwelling unit cannot be placed on the parcel due to safety concerns of reduced ingress and egress. Section 2. Severability. If any provision of this Ordinance or the application thereof to any person or circumstances is for any reason held to be invalid by a court of competent jurisdiction, such provision shall be deemed severable, and the invalidity thereof shall not affect the remaining provisions or other applications of the Ordinance which can be given effect without the invalid provision or application thereof. Section 3. Effective Date and Publication. This Ordinance shall take effect thirty (30) days after the date of its passage. The Times Herald Vallejo, SUMMARY OF AN ADOPTED ORDINANCE NO. 2016-1773 PLACING ON THE NOVEMBER 8, 2016 BALLOT A PROPOSED GENERAL BUSINESS LICENSE TAX ON MARIJUANA BUSINESSESS MEASURE At its regular meeting on August 9, 2016, the Solano County Board of Supervisors adopted an ordinance to amend Article XII to Chapter 11 of the Solano County Code to enact a general business license tax on marijuana businesses within the County for general governmental purposes, to be levied at a maximum rate of 15% of each one dollar of gross receipts on the businesses, commencing January 1, 2018, as authorized by Revenue and Taxation Code section 7284, which shall continue until repealed by the Board of Supervisors or County voters, and placed it on the November 8, 2016 ballot. Under the ordinance, marijuana has the same meaning as "Cannibas" as defined in Business and Professions Code section 19300.5, subdivision (f), as may be amended from time to time. The ordinance will become effective immediately if approved by a majority of the qualified voters of the entire county voting on the measure.
