BIG HORN CIRCLE RIGHT-OF-WAY IN GREAT WESTERN PARK WHEREAS, on February 10, 2009, the City Council of Broomfield approved the final plat for Great Western Park Filing No. 4, located south of 112th and West of Simms Street in the City and County of Broomfield, State of Colorado; and WHEREAS, by such plat the property owner dedicated to the City, and the City accepted streets and rights-of-way including but not limited to, Bobcat Court and N. Front Range Classifieds, ORDINANCE NO. 887 AN ORDINANCE APPROVING A REZONING AND OUTLINE DEVELOPMENT PLAN AMENDMENT FOR A PORTION OF THE OAK MEADOWS P.U.D. Front Range Classifieds, ORDINANCE NO.888 AN ORDINANCE APPROVING A LEASE AGREEMENT BETWEEN THE TOWN OF FIRESTONE AND ADAMS BANK & TRUST FOR THE LEASE OF OFFICE SPACE LOCATED AT 8308 COLORADO BOULEVARD WHEREAS, the Town has the authority to lease property in accordance with applicable law, including but not limited to, C.R.S. § 31-15-101; and WHEREAS, the Board of Trustees deems it necessary and desirable for the efficient and proper functioning of the Town to lease space to meet the current needs of the Town for professional office space; and WHEREAS, for such purpose, there has been proposed a lease agreement between the Town and Adams Bank & Trust for the Town to lease approximately 2,350 square feet of professional office space located at 8308 Colorado Boulevard in the Town of Firestone; and WHEREAS, the Board of Trustees has determined it is in the best interest of the Town to enter into the lease contemplated herein. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO: Section 1. The Mayor is hereby authorized to execute such Lease on behalf of the Town, except the Mayor is hereby further granted the authority to approve such revisions to said Lease as determined necessary or desirable for the protection of the Town, so long as the essential terms and conditions of the Lease are not altered. Section 3. The Mayor, Town Clerk, Town Manager and Town staff are authorized to execute such other documents as are necessary to implement the Lease, and to make payments under the Lease for which funds are legally available. The Town's financial obligations under the Lease are expressly subject to annual appropriation by the Board of Trustees and nothing in this ordinance or the Lease is intended or shall be construed to create any multiple-fiscal year direct or indirect Town debt or fiscal obligation whatsoever. Section 4. If any article, section, paragraph, sentence, clause, or phrase of this ordinance is held to be unconstitutional or invalid for any reason, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The Board of Trustees hereby declares it would have passed this ordinance and each part or parts hereof irrespective of the fact that any one part or parts be declared unconstitutional or invalid. Section 5. All other ordinances or portions thereof inconsistent or conflicting with this ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or conflict. The Reporter- Vacaville, CITY OF VACAVILLE DEPARTMENT OF PUBLIC WORKS NOTICE TO BIDDERS Sealed proposals for the work shown on the Project Plans entitled: Merchant Street ADA and Traffic Improvements Project must be delivered to and received by the Office of the City Clerk of the City of Vacaville, 650 Merchant Street, Vacaville, California 95688 by 2:00 P.M. on September 8, 2016, at which time they will be publicly opened and read aloud at said address, in accordance with the Project Plans and Special Provisions. Bidders are responsible for ensuring that their proposals are received in the office of the City Clerk by the time and date specified above. Any proposals that are not timely received in the office of the City Clerk shall be returned unopened. The general description of work includes removal of existing Portland cement concrete and asphalt concrete sidewalks and driveways and construction of new ADA compliant sidewalks, driveways and ramps, revision of the existing traffic signal and streetlights, removal and restriping of the roadway and such other items or details not mentioned above, which are required by the Project Plans, Standard Specifications, or these Special Provisions to be performed, placed, constructed or installed. This is a Federally assisted construction project. This Project is partially funded through the Housing and Urban Development (HUD), Community Development Block Grant program and is subject to all applicable Federal rules and regulations thereof. This project is subject to the "Buy America" provisions of the American Recovery and Reinvestment Act of 2009 and amendments thereafter. No Pre-Bid Meeting is scheduled for this project. The Contractor shall possess a Class A, "General Engineering Contractor" license at the time this Contract is awarded by the City Council of the City of Vacaville. This Contract is subject to State Contract Nondiscriminatory and Compliance Requirements pursuant to California Government Code, commencing with Section 12900 through Section 12996. Inquiries or questions based on alleged patent ambiguity of the project plans or specifications must be communicated as a bidder inquiry prior to bid opening. Any such inquiries or questions, submitted after bid opening, will not be treated as a bid protest. The Project Plans, Special Provisions, and Proposal Form for bidding this project shall only be obtained through BPXpress Reprographics, located at 4740 East Second Street #29, Benicia, CA 94510, (707) 745-3593, www.blueprintexpress.com/vacaville. These items may be obtained by prospective bidders upon receipt of a non-refundable fee of Seventy Dollars and No Cents ($75.00) per set, plus shipping. Any bids received from a bidder who did not purchase a complete bid set from BPXpress Reprographics will be considered non-responsive and their bid shall be rejected. Bids are required for the entire work described herein. Refer to Section 3-1.02 of these Special Provisions for Payment and Performance Bond Requirements. Refer to Section 5-1.02F of these Special Provisions for requirement of Contractor and Sub-contractors to be registered with the Department of Industrial Relations (DIR) to be eligible to submit a responsive bid. The successful Bidder shall furnish a Payment Bond and a Performance Bond in the amount of 100% of the Contract within ten (10) calendar days, not including Saturdays, Sundays, and designated Legal Holidays, after date of the Notice of Award letter. The Contractor may elect to receive 100% of payments due under the Contract document from time to time, without retention from any portion of the payment by the City, by depositing securities of equivalent value of the retained amount with the City in accordance with the provisions of Section 22300 of the Public Contract Code. Such securities, if deposited by the Contractor, shall be valued by the City, whose decision on valuation of the securities shall be final. Securities eligible for investment under this provision shall be limited to those listed in Section 22300 of the Public Contract Code and Section 16430 of the California Government Code. The Contractor shall indemnify and hold harmless the City from any and all loss or damage suffered by the City as a result of any wrongful or negligent act or omission on the part of the Contractor or any of its officers, employees or agents with respect to the performance for Escrow Agreement. Pursuant to Section 1773 of the Labor Code, of the State of California, the "General Prevailing Wage Rates" in the County in which work is to be done have been determined by the Director of the California Department of Industrial Relations. These wages are set forth in the General Prevailing Wage Rates for this project, available for examination at the City of Vacaville Department of Public Works, and available from the California Department of Industrial Relations' internet website at http://www.dir.ca.gov/DLSR/PWD/index.htm. Future effective general prevailing wage rates, which have been predetermined and are on file with the California Department of Industrial Relations are referenced but not printed in the general prevailing wage rates. The Federal minimum wage rates for this project, as predetermined by the United States Secretary of Labor, are as set forth in the project Special Provisions and are posted by the U.S. Department of Labor on the United States Government Printing Office's website at http://www.gpo.gov/davisbacon. Addenda to modify the Federal minimum wage rates, if necessary, will be issued to holders of the project Special Provisions. The Contractor's attention is directed to the Federal minimum wage rate requirements as set forth in the project Special Provisions. If there is a difference between the minimum wage rates pre-determined by the Secretary of Labor and the general prevailing wage rates determined by the Director of the California Department of Industrial Relations for similar classifications of labor, the Contractor and Subcontractors shall pay not less than the higher wage rate. The City will not accept lower State wage rates not specifically included in the Federal minimum wage determinations. This includes "helper" (or other classifications based on hours of experience) or any other classification not appearing in the Federal wage determinations. Where Federal wage determinations do not contain the State wage rate determination otherwise available for use by the Contractor and Subcontractors, the Contractor and Subcontractors shall pay not less than the Federal minimum wage rate, which most closely approximates the duties of the employees in questions. The U.S. Department of Transportation (DOT) provides a toll-free "hotline" service to report bid rigging activities. Bid rigging activities can be reported Mondays through Fridays, between 8:00 AM and 5:00 PM Eastern Time, Telephone No. 1-800-424-9071. Anyone with knowledge of possible bid rigging, bidder collusion, or other fraudulent activities should use the "hotline" to report these activities. The "hotline" is part of the DOT's continuing effort to identify and investigate highway construction contract fraud and abuse and is operated under the direction of the DOT Inspector General. All information will be treated confidentially and caller anonymity will be respected. The City reserves the right to reject any or all bids, and to determine which proposal is, in its judgment, the lowest responsive bid of a responsible bidder and which proposal should be accepted in the best interest of the City. The City also reserves the right to waive any irregularities in any proposal or bid. Proposals in which the prices are obviously unbalanced may be rejected.
